Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the website located at insulationmenifee.com (the "Site") and your engagement with Menifee Insulation ("Company," "we," "our," or "us") for insulation services. By accessing the Site or contacting us to request services, you agree to be bound by these Terms in full. If you do not agree with any part of these Terms, please do not use the Site or engage our services.

Use of the Website

The Site is provided for informational purposes and to facilitate contact between prospective customers and Menifee Insulation. You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site. Prohibited uses include but are not limited to:

• Submitting false, misleading, or fraudulent information through any form on the Site.
• Attempting to gain unauthorized access to any part of the Site or our systems.
• Using automated tools, bots, or scrapers to access, collect, or copy content from the Site without our prior written consent.
• Transmitting any material that contains viruses, malware, or other harmful code.

We reserve the right to terminate or restrict access to the Site for any user who violates these Terms.

Estimates and Quotes

Any estimate or quote provided by Menifee Insulation, whether through the Site, by phone, by email, or in person, is based on information available at the time of preparation. Written estimates are valid for 30 days from the date issued unless otherwise stated. Estimates are subject to revision if conditions at the job site differ materially from what was represented or observed during the initial assessment.

An estimate is not a binding contract. A project commences only upon execution of a written service agreement signed by both parties.

Service Agreements

All insulation work performed by Menifee Insulation is governed by a separate written service agreement. In the event of any conflict between these Terms and a signed service agreement, the service agreement shall control with respect to the specific project it covers. The terms of service agreements may include project scope, material specifications, timeline, payment schedule, and warranty terms.

Payment Terms

Payment terms for specific projects are set forth in the applicable service agreement. Unless otherwise stated in writing, a deposit may be required before project commencement, with the remaining balance due upon project completion. We accept check, ACH bank transfer, and major credit cards. A processing fee may apply to credit card payments exceeding a threshold specified in the service agreement.

Invoices that are not paid within the period specified in the service agreement may be subject to a late fee. We reserve the right to pursue all legally available remedies for non-payment, including referral to a collection agency and reporting to credit bureaus, as permitted by California law.

Licensing and Compliance

Menifee Insulation holds a California contractor's license issued by the Contractors State License Board (CSLB) and maintains general liability insurance and workers' compensation coverage as required by California law. Where permits are required by local authorities for insulation work, we obtain them prior to commencing the permitted scope of work, unless otherwise agreed in writing with the customer.

Limitation of Liability

To the maximum extent permitted by applicable law, Menifee Insulation's liability arising out of or related to your use of the Site or our services shall be limited to the amount you actually paid to the Company for the specific service giving rise to the claim. The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.

This limitation of liability does not apply to damages caused by the Company's gross negligence or willful misconduct.

Disclaimer of Warranties

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

Information about energy savings, comfort improvements, or other outcomes presented on the Site is illustrative and not a guarantee of specific results. Actual outcomes depend on many factors outside our control, including home construction, occupant behavior, and climate conditions.

Intellectual Property

All content on the Site, including but not limited to text, images, graphics, logos, and design elements, is the property of Menifee Insulation or its content suppliers and is protected by United States copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our express written permission.

Third-Party Links and Services

The Site may contain links to third-party websites or use third-party services (such as form and analytics providers). These links and services are provided for your convenience and informational purposes only. Menifee Insulation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Accessing any third-party site is at your own risk.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Riverside County, California.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the Effective Date at the top of this page. Changes are effective immediately upon posting. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
